The man, 34 years old, had been residing and working in the Greater Poland region in the western part of the country. He now faces a five-year ban from re-entering not just Poland, but the entire Schengen Area. According to reports, museum guards detained him in mid-July after he made the gesture while posing for photos during his visit to the memorial site. Police subsequently charged him with publicly promoting Nazism, along with desecrating a location that honors the memory of Holocaust victims.

On Wednesday, he was handed over to Border Guard officials in Kraków, who issued a formal return order on the grounds of public order and security. Justyna Drożdż, spokesperson for the Border Guard's Kraków branch, confirmed that a court had ruled he must be held at a detention facility for foreigners in Przemyśl, a city in the southeast, while his deportation is processed.

Legal Consequences and Historical Weight
Poland takes such acts seriously under its legal code - promoting Nazi, fascist, communist, or other totalitarian ideologies in public can result in a fine, restrictions on personal liberty, or even up to two years behind bars. As part of the investigation, authorities seized the mobile phone that was used to capture the photographs, using it as evidence in the case. The man reportedly admitted to the act and agreed to pay a fine of 2,000 złoty, roughly €460.

Auschwitz-Birkenau holds deep historical significance as the largest concentration and extermination camp built by Nazi Germany during its occupation of Poland in World War II. More than 1.1 million people lost their lives there, the vast majority of them Jewish victims of the Holocaust.
