A significant amendment to the Labor Code is on the way and it will be effective as of next year. A reform being prepared now in the Ministry of Family, Labor and Social Policy could improve the situation for millions of Polish workers. If such an amendment passes, an employee’s length of service with include work under civil law contracts and time spent running a business — retroactively to the beginning. This change will qualify employees for additional leave and other monetary benefits.

More Than Just Leave Rights
But the broader recognition of work experience will not just affect vacation entitlements. Greater seniority might also entitle employees to jubilee bonuses, severance pay or other occupational benefits tied to years of service.
This change is expected to give a more accurate reflection of peoples’ professional history and the contribution they make to the economy.
How to Confirm Work History
In order to document previous employment correctly, ZUS will also give certificates for contracts during which social insurance premiums were paid for. In other instances, such as helping family members with a family business, or work performed abroad for example, people will have to provide evidence of the claim, such as contracts, invoices or written statements.
The Ministry promises that procedures will be well defined and state institutions will help gather the necessary papers.
According to information from the BAEL 2023 (Population Economic Activity Survey), nearly 20% of working Poles, or approximately 1.9 million people, are employed in non-standard full-time jobs. This reform also gives them greater visibility on their CV, for employers and for the public system.
