Procedures were turned digital and deadlines tightened
The updated rules now require employers to use digital systems via the praca.gov.pl platform. The labor market test requirement has been removed to help facilitate the start of the hiring process. But new rules also require tighter deadlines for reporting. Employers must deliver contracts of employment by electronic means, and are required to notify both early termination of a contract and any relevant changes in employment conditions within two months (rather than three).
Larger fines and more restrictions
The rules also include stricter protections to stop misuse. There are new requirements for the refusal of permissions under some visa categories, while companies that outsource work will end up with new constraints.
Temporary work agencies must be established for at least two years when recruiting foreigner workers and are required to pay a PLN 1,000 fee if they are not entered into a register by June 1, 2025. Under the new regulations, employers found to have hired undocumented workers may be fined up to PLN 50,000 for each such worker. Businesses are warned to strictly observe the rules, perhaps consulting a lawyer to ensure they do not incur heavy fines.
